5. Fees and payment

Where our services are paid, applicable fees, billing terms, and accepted payment methods will be set out at the point of purchase or in a separate agreement. All fees are stated in GBP unless otherwise indicated, and are exclusive of any applicable taxes (including VAT) which will be added where required.

Payments are processed by trusted third-party providers (such as Stripe). By making a payment you agree to the relevant processor's terms in addition to these Terms.

Refunds are governed by our Refund Policy.

Our services may integrate with or link to third-party platforms (such as Apple App Store, Google Play, payment processors, and cloud providers). We are not responsible for the content, policies, or practices of those third parties. Your use of third-party services is subject to their own terms and conditions.

Subject to the above, to the maximum extent permitted by law, Vibestack Ltd's total liability arising out of or in connection with these Terms or your use of our services will not exceed the greater of (a) the total amount you paid us in the 12 months preceding the event giving rise to liability, or (b) £100. We are not liable for indirect, consequential, special, or incidental damages, loss of profits, loss of data, or loss of goodwill.

11. Indemnity

You agree to indemnify and hold harmless Vibestack Ltd, its directors, officers, employees, and contractors from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your violation of law, or your misuse of our services.

12. Privacy

Your use of our services is also governed by our Privacy Policy, which forms part of these Terms.

13. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws of your country of residence apply.
